Massachusetts Lawyers Weekly quotes Jon Barooshian in “Carriage of Justice”

Massachusetts Lawyers Weekly published the article “Carriage of Justice,” which details the legal battle between the IRS and a client of Jon Barooshian and Matt Morris. The client, a Nantucket resident, purchased a parcel on the island and, in order to build his dream home, needed to raze two structures on the lot. He donated one of the structures, a carriage house, to a local Nantucket nonprofit. After the client claimed a tax deduction for the donation, the IRS challenged the deduction for lack of “donative intent.” The brief article details the widespread misconception that a donation of property to a 501(c)(3) charity will automatically be treated by the IRS as having requisite donative intent.
