The coronavirus has been prompting the urgent review of often overlooked clauses to keep up with this new and rapidly changing environment. David discusses force majeure clauses and how they can be applicable to the situations going on today:
A first step for in-house counsel and others advising companies is to assess just what the legal rights are for parties to a contract, taking into account reticence of courts to allow parties to use force majeure clauses as an escape hatch, Mawhinney said.
