Amy Fabiano Quoted in The Chronicle of Higher Education in “The Education Dept. Tried to Draw a Line Between Free Speech and Discrimination. It’s Still Blurry.”

The May 7, 2024, Dear Colleague Letter issued to educational institutions by the U.S. Department of Education’s Office for Civil Rights discussed how Title VI of the Civil Rights Act of 1964 applies to discrimination based on shared ancestry or ethnic characteristics. The letter was a reminder to colleges that federal law bars discrimination on the basis of shared ancestry and ethnic characteristics. Amy Fabiano discussed the new guidance with The Chronicle of Higher Education.

Amy said that institutions should read the guidance closely and noted that while the examples the letter gives are “fairly straightforward,” and not as nuanced as the questions her clients have been raising, institutions may be able to “extrapolate from them to what’s going on on your campus.” She added that “As things have escalated on campus, this guidance is really welcome.”
