Worcester Medicine Publishes “Privacy Breaches and Invasions”
The Worcester District Medical Society published an article by Peter Martin in the March/April 2016 edition of its quarterly publication, Worcester Medicine, examining a late 2015 Superior Court decision potentially expanding use of a Massachusetts “right to privacy statute” by patient victims of medical records breaches seeking damages. This contrasts with previous precedent citing HIPAA and Massachusetts data privacy laws, which had established a higher standard of financial or reputational harm arising from a breach for a plaintiff to obtain compensation.
