The Real Reporter published an article by Bowditch & Dewey’s Real Estate & Environmental Practice Area Leader, Paul Bauer, on November 21 discussing the challenges that landlords and prospective marijuana retailers may encounter now that recreational use of the drug is set to become legal in Massachusetts in December. The potential for enforcement of federal law banning the drug, state licensing and permitting issues, and contractual terms between landlord and dispensary barring expansion all present hurdles for property owners and prospective retailers.
