Massachusetts Cannabis Control Commission Proposes New Host Community Agreement Regulations
The amendments to M.G.L. c. 94G enacted as Chapter 180 of the Acts of 2022 require that, no later than November 9, 2023, the Cannabis Control Commission (“Commission”) promulgate new regulations for Host Community Agreements (“HCAs”) between marijuana establishments or medical marijuana treatment centers with the municipalities in which they plan to operate. The Commission’s draft regulations related to HCAs (935 CMR 500.179-181) were included in the July 13, 2023, public meeting packet and begin at page 135 of the packet. Promulgation of new agency regulations is governed by M.G.L. c. 30A, the Massachusetts Administrative Procedures Act, which requires that draft regulations be published and opened for public comment before they are finalized.
