Bowditch is proud to have been selected by Acadia Insurance to provide construction contract review services to Acadia customers at a special rate ($750). Bowditch is a regional law firm which represents owners, developers, contractors and subcontractors in all phases of development and construction projects.
Bowditch has agreed to provide Acadia customers services reviewing and modifying subcontract agreements to ensure that certain critical risk transfer provisions are included and properly drafted to protect from unanticipated and potentially substantial liabilities.
Should you choose to hire Bowditch under this program, you will get the following:
- Experienced construction lawyers will review your existing form of subcontract agreement and will discuss their findings with you directly to better understand what you need from your contracts.
- The following provisions will be modified or added, at your election, to fit your needs and Acadia’s underwriting requirements:
- Indemnity provisions
- Insurance requirements
- Flow-through of General Contract – Owner contract terms to limit scope gaps and inconsistencies between your obligations to the owner and your subcontractor’s obligations to you.
- Warranty provisions (scope, duration, alignment with completed operations insurance requirements)
The first step to participating in this program is completing and submitting the fields below, so that we can verify that you qualify for this program and the fixed fee of $750. You may complete and submit the form below or print and email a completed copy to contractreview@bowditch.com.
Once you complete and submit this form and Bowditch has confirmed eligibility, an engagement letter will be sent to you by email for your electronic signature, along with instructions for paying the fee. Once you have hired Bowditch, one of our construction lawyers will reach out to schedule an initial call and begin working on your matter.
No Attorney-Client relationship will be formed by submitting this information to Bowditch. Bowditch will not commence representation until it has confirmed that it has no conflict of interest in connection with the representation, you have executed a legal services engagement letter with Bowditch, and you have paid the legal fee under this program. The $750 fee for this program covers a limited scope of engagement to review, draft and revise four provisions of your standard form construction subcontract, including: (1) indemnification, (2) insurance requirements, (3) warranties, and (4) flow-down provisions. The specific terms and scope of the engagement will be specifically set forth in a legal engagement letter. While Acadia Insurance has selected Bowditch as its exclusive vendor for this program, the Firm does not represent Acadia Insurance as a client and Acadia does not subsidize or otherwise pay for the services provided by Bowditch. If you engage Bowditch, you will be the firm’s client and the firm’s professional obligations will extend solely to you. Confidential information you share with us and advice we provide to you will be protected by the Attorney-Client Privilege and will not be shared with Acadia Insurance or any other third party without your express permission.
