The trusts, which are commonly used in Massachusetts to ensure that firearms are transferred in accordance with owners’ wishes, can currently be administered by people who have not undergone background checks. By instituting new regulations that require any administrator or beneficiary of a gun trust to undergo a vetting process, the Bureau of Alcohol, Tobacco and Firearms aims to “ensure that the identification and background check requirements apply equally to individuals, trusts, and legal entities.” Any gun trust established after July 13 will need to adhere to the new regulations.
