Overview

Christopher Condon is a problem solver with a track record of assisting companies and individuals in successfully navigating economic distress. With more than 20 years’ experience in commercial restructuring and related litigation, he provides thoughtful advice and finds innovative solutions to complex disputes.

Chris has counseled clients across a broad spectrum of business sectors from biotech and medical devices to construction and real estate. He has assisted businesses in dire economic circumstances and has often been able to effectuate a successful restructuring of debt, preserving assets, jobs and value for equity holders. While he is a skilled and effective courtroom advocate when necessary, Chris seeks to resolve conflicts quickly and efficiently, without the costs and delays of litigation.

Having spent his career first principally representing lenders and later primarily representing borrowers, Chris has spent time on both sides of the restructuring world and finds helping business owners resolve contests with lenders to be the most rewarding. He regularly represents debtors of all sizes in restructuring their obligations in both formal bankruptcy proceedings and in out-of-court workouts and refinancings. Chris strongly believes that while bankruptcy is a valuable tool that provides many unique remedies for debtors, it is one which should be employed strategically.

Chris also regularly represents creditors in pressing their claims to obtain the maximum recovery in the shortest amount of time.

Experience
  • Represented Chapter 11 Debtor, a research entity engaged in the application of electromagnetic chemistry. Successfully defended the efforts of the principal competitor to seize control of the Debtor’s assets and closed on the sale of substantially all assets after a multi-day contested trial, resulting in a continuation of the Debtor’s research and a new equity infusion.
  • Represented the Chapter 11 Trustee of a more than 100-year-old, well-known candy manufacturer and distributor in New England. Consummated a distressed sale of substantially all assets. Prosecuted and resolved disputed claims against the lender, directors and officers, and principal shareholder, which disallowed more than $150 million of disputed claims and permitted many of the company’s iconic brands to continue to be produced.
  • Represented Chapter 11 Debtor, the owner and operator of a seafood processing facility.  Developed and implemented competitive bidding process, consummated contested sale of substantially all assets, and confirmed Chapter 11 Plan.
  • Represented Creditors’ Committee and Plan Trustee of automotive floorplan lender, whose business assets were sold. Confirmed joint Chapter 11 Plan and effected orderly wind down of business with significant recovery to creditors.
  • Represented five Chapter 11 Debtors, owners and operators of waste collection and recycling facilities. Confirmed Plan that restructured approximately $100 million of debt and provided for equity’s retention of ownership.
  • Counsel to large compressed natural gas provider on East Coast that defaulted on its obligations to multiple lenders. Successfully negotiated and documented a global restructuring of more than $140 million of debt.
  • Represented Creditors’ Committee in Chapter 11 proceeding of a general contractor with yearly revenue in excess of $300 million, liabilities in excess of $80 million and over 200 open contracts.
  • Represented Chapter 11 Debtor, the owner and operator of a private golf club in southern Massachusetts in a contested reorganization and valuation dispute. Confirmed Plan of reorganization over the objections of secured creditors, ultimately permitting the sale of the property.
  • Counsel to developer and manufacturer of integrated circuits and semiconductors, which suffered substantial losses as a result of the COVID-19 outbreak triggering loan covenant defaults. Negotiated global restructuring of substantial debt with a large regional bank.
  • Represented a single purpose LLC in the successful contested Chapter 11 reorganization of a multi-million-dollar residential property resulting in the preservation of $3 million of equity.
  • Represented a principal creditor and holder of multiple convertible notes in the Chapter 11 proceeding of a cannabis product manufacturer.
  • Represent and advise the owner of multiple commercial real estate entities in various tenant-bankruptcy contexts.
